The Closing Procedure
- Contract fully executed by both parties.
- Earnest money deposited with Realtor or Seller Attorney.
- Loan application initiated by Buyer.
- Buyer must order Termite and Septic inspection.
- Property inspection ordered by Buyer.
- Copy of inspection to Buyer and Seller, Buyer must provide Seller with repairpriority list.
- Appraisal ordered by Lender.
- Appraisal complete. The appraisal may have lender-required repairs.
- Seller orders repair work with priority to lender-required repairs, and then buyer inspects repairs.
- Repairs completed and approved by Lender and Buyer.
- Lender approval of Buyer.
- Attorney to order title insurance and survey.
- Survey approved by Title Company.
- Closing date set.
- Buyer arranges insurance for home. Provides this information to Lender
- Confirm closing figures with Attorney. Buyer must bring cashier's check or certified funds to close.
- Pre-closing walk through conducted by Buyer
- Check must be made out to Attorney’s Trust Account.
- Close transaction.
Buyer's Checklist for Purchase:
- Contract signed
- Initial deposit paid
- Attorney Review complete
- Begin Mortgage Application process
- Home inspection scheduled
- Additional deposit paid
- Negotiate home inspection issues
- Obtain Mortgage Commitment
- Attorney to order title and survey
- Schedule closing
- Obtain final figures and certified funds for closing
- Do final walkthrough
- Attend closing, sign mortgage documents and receive keys
- Have utilities transferred
- Deed and Final Title Policy to be received about 3-6 months after closing.
Seller's Checklist for Sale:
- Contract signed
- Attorney Review complete
- Initial deposit received
- Buyer completes home inspection
- Additional deposit received
- Home inspection issues resolved
- Provide back title and survey to our office
- Mortgage commitment received
- Title received and reviewed by attorney
- Payoff information provided to attorney for all mortgages and equity lines
- Freeze any equity lines
- Make sure smoke detectors, CO detectors and fire extinguisher properly installed and operating
- Get Certificate of Occupancy/Smoke Inspection from township
- Order final water reading
- House in broom clean condition for walkthrough
- Transfer utilities
- Leave any extra keys, garage door openers, booklets in the house
